TERMS OF SERVICE AGREEMENT

(vii) Use any data mining, robots, or similar data gathering or extraction methods on the Services;

(viii) Upload or transmit any viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, or other harmful programs or similar computer code;

(ix) Use the Services to solicit or promote any products or services without our prior written consent.

  1. Intellectual Property

a) The Services and all content and materials contained therein, including without limitation, text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, are the property of Parth Jethva Visuals or its licensors and are protected by copyright laws.

b) You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal and non-commercial use.

c) You may not modify, copy, reproduce, distribute, transmit, display, perform, publish, license, create derivative works from, transfer, or sell any content or materials contained on the Services without our prior written consent.

  1. Disclaimers and Limitation of Liability

a) The Services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

b) Parth Jethva Visuals does not warrant that the Services will be uninterrupted or error 

-free, or that any defects in the Services will be corrected. We do not warrant that the Services or any content or materials available on the Services are free of viruses or other harmful components.

c) In no event shall Parth Jethva Visuals or its affiliates, directors, officers, employees, agents, or licensors be liable to you or any third party for any indirect, consequential, incidental, special, or punitive damages, including without limitation, loss of profits, loss of data, or loss of goodwill, arising from or in connection with the use of or inability to use the Services, even if we have been advised of the possibility of such damages.

d) In no event shall the total liability of Parth Jethva Visuals or its affiliates, directors, officers, employees, agents, or licensors to you or any third party arising out of or in connection with these Terms of Service exceed the total fees paid by you, if any, to Parth Jethva Visuals for the use of the Services during the twelve (12) month period prior to the event giving rise to the liability.

  1. Indemnification

You agree to indemnify, defend, and hold harmless Parth Jethva Visuals and its affiliates, directors, officers, employees, agents, and licensors from any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or in connection with your use of the Services, your breach of these Terms of Service, or your violation of any applicable law or third-party right.

  1. Governing Law and Dispute Resolution
